Understanding the basics of Applying for Asylum in the United States
When Mary was a young girl she was taken from her village and forcibly circumcised. She is the victim of FGM (female genital mutilation). When Mary became an adult, she decided to leave her home country and come to the United States. While she was in the U.S., our firm, Yevoli and Malayev, PLLC had the privilege of meeting with her. Once we began talking to Mary about her life back home, it came to our attention that she had been circumcised. Based on this past harm, we advised Mary that she may be eligible for a grant of asylum. We then worked with Mary to gather documents from her home country, as well as arranging for her to be examined by a doctor in the U.S. who confirmed her circumcision. We represented Mary at her asylum hearing, where we are thrilled to say she was granted asylum.
We have also had the privilege of representing John. John is a gay man, who lived in an African country that has a law that punishes same-sex relationships. One night he was found with his romantic partner and beaten and threatened by the vigilantes in the community. Fearing for his life, he fled his home country and traveled to the United States. Once he arrived in the U.S., he was detained at the border and put into removal proceedings, where he applied for asylum based on his sexual orientation. Our law partners worked closely with John and his supportive contacts back home to gather evidence to present to the Immigration Judge. We worked tirelessly with John to make sure his claim met all the necessary elements for a grant of Asylum. These are just two of the hundreds of clients we have successfully represented from Africa.
Asylum law is complex and although many people may have hardships in their home country, not every issue warrants a grant of asylum. Below we will breakdown the basics of asylum law in the United States.
